of Use for EV Charging Mobile Application ChargeIT
1. Introduction
Welcome to HELLAS POWER P.C These Terms and Conditions ("Terms") govern your use of the HELLAS POWER P.C Services and the installation and utilization of the accompanying application ("ChargeIT App"). By accessing and using our Services, including the ChargeIT App, you agree to be bound by these Terms. Please ensure that you are of legal age (18 years or older) and have the authority to consent to these Terms before using our Services.
We may update these Terms from time to time, and any modifications will be communicated to you via email and through notifications within the ChargeIT App. We reserve the right to modify or update these Terms at any time without prior notice It is your responsibility to regularly review these Terms, as your continued use of our Services after any modifications constitutes acceptance of the updated Terms. These Terms supersede any prior agreements or arrangements with End Users.

2. Description of Services
The App provides users with access to electric vehicle (EV) charging stations, location information, availability, pricing, and related services . The Services may also include features such as navigation to charging stations, payment processing, user reviews, and community forums.
HELLAS POWER P.C grants you a limited, non-exclusive, personal, non-transferable, and non-sublicensable license to use the ChargeIT App, subject to the limitations outlined in these Terms.
You are enabled to utilize any Charging Stations on the Network for recharging your Electric Vehicle, provided you adhere to the Rules for Safe Charging.
3. User Accounts
You may be required to create an account to access certain features of the App. When creating an account, you agree to provide accurate and complete information and to keep your login credentials secure. You are solely responsible for any activity that occurs under your account. We can use this data for legal or taxiation purposes and you are responsible for the accurancy of the information. You always keep the right to delete your account along with all the data exluding the tax documents (receipts, business invoices) which are required by law. In case of account deletion you will not be able to recover your account and you cannot reclaim or transfer to other account any unused walllet amount.
4. Use of the App
You agree to use the App in compliance with all applicable laws, regulations, and these Terms. You may not use the App for any unlawful or unauthorized purpose, including but not limited to violating intellectual property rights, transmitting viruses or other harmful code, or engaging in fraudulent activity.Please follow the instructions within the app for proper usage.
5. Charging Stations
The App provides information about EV charging stations, including location, availability, pricing, and other details. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, reliability, or availability of this information. You are solely responsible for verifying the availability and compatibility of charging stations before use.
6. Payments
Some features of the App may require payment, such as charging station fees or subscription services. By using these features, you agree to pay all applicable fees and charges. Payments are processed through third-party payment processors, and your use of these services is subject to their terms and conditions.To recharge your vehicle, it is necessary to have a balance in the application wallet capable of covering the cost of charging
7. Refunds
Your wallet balance is used to pay for Charging Sessions and other services offered through the ChargeIT App. Any refund issued for wallet transactions will be credited back to your wallet balance for future use.
7.a. Refund Eligibility* .
Refunds may be considered under the following circumstances:
* Technical Issues: If a technical malfunction occurs during a Charging Session, resulting in the inability to complete the charging process and a false charge is created
* Duplicate Charges: If you are erroneously charged multiple times for the same Charging Session.
7.b. Refund Process
To request a refund, you must contact HELLAS POWER P.C within 24 hours of the issue occurring. Refund requests can be submitted through the ChargeIT App or by contacting our customer support team directly.
Charges incurred due to user error or misuse of the ChargeIT App or Charging Infrastructure or Charges resulting from failure to comply with the Rules for Safe Charging outlined in the Terms and Conditions.are not eligible for refund. Wallet amount also cannot be refunded and can only be used for future transactions
8. Privacy Policy
Your use of the App is subject to our Privacy Policy which describes how we collect, use, and disclose your personal information. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
9. User Content
The App may allow you to submit or share content, such as reviews, ratings, comments (collectively, "User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to submit User Content and grant the foregoing license. You agree not to submit any User Content that is unlawful, defamatory, infringing, obscene, offensive, or otherwise objectionable.
10. Intellectual Property
The App and its content, including but not limited to text, graphics, logos, and software, are protected by intellectual property rights owned or licensed by HELLAS POWER P.C. You may not use, reproduce, modify, adapt, distribute, or display any content from the App without the express permission of the rights holder.
11. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted or error-free, that defects will be corrected, or that the app or the servers that make it available are free of viruses or other harmful components
12. Limitation of liability
In no event shall HELLAS POWER P.C be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, arising out of or in connection with your use of the app or any content or services made available through the app.
13. Indemnification
You agree to indemnify and hold harmless , HELLAS POWER P.C, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including legal fees, arising out of or in connection with your use of the App or your violation of these Terms.
14. Modifications to Terms
We reserve the right to modify or update these Terms at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review the Terms periodically for any updates.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, Greece.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions of these Terms will remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and HELLAS POWER P.C regarding your use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
